CornerSwitch Private Limited (the “Company”) operates a mobile application, “AccoFarm” (the “App”), available for Android devices and also operates a website https://accofarm.com (the “Website”). The App and the Website shall be called the “Platform” together. These terms and conditions (“Terms”) govern the use of or access to the Platform and the Services (as defined below).

The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice, and all Agreements: “User,” "Client," "You," and "Your" refer to you, the person logged on to this website and compliant with the Company’s terms and conditions. "The Company," "Ourselves," "We", "Our," and "Us" refer to our Company. "Party," "Parties," or "Us" refers to both the Client and ourselves. All terms refer to the offer, acceptance, and consideration of payment necessary to undertake the process of our assistance to the Client most appropriately for the express purpose of meeting the Client’s needs in respect of the provision of the Company’s stated services following and subject to, prevailing law of India. Any use of the above terminology or other words in the singular, plural, capitalization, and/or he/she or they are taken as interchangeable and, therefore, as referring to the same.

By using the Platform or the services, you agree that you have read, understood, and are bound by these Terms and comply with the requirements listed herein. Services

The Platform provides an online digital farm management system wherein the users (“Users”) or the owners of the farm can manage their farm by

1. Creating the workers
2. Marking and tracking the attendance of the workers
3. Tracking and categorizing the income and expenses of the farm
4. Managing the payments and ledger accounts of the workers
5. Tracking the farm, blocks, crops, yields, work, work allocation, and
6. View and download the reports.

For the purposes of this clause, Services would include any other future services the Company provides/proposes to provide.

On-Boarding

A user needs to provide basic details such as name, phone number, email ID, and/or address and thus will be provided access to the platform with login credentials. In addition, the platform may collect location information to offer suitable regional services.

The User is solely responsible for maintaining the security and confidentiality of their username and password and agrees to immediately notify the Company in writing at hello@accofarm.com of any disclosure or unauthorized use of its Profile or any other security breach concerning its Profile.

The User expressly agrees to be liable and accountable for all activities through its Profile in furtherance of the use of Service or otherwise. The Company expressly excludes any liability for unauthorized access to a User’s Profile.  

The User agrees to receive communications from the Company regarding

1. Information relating to transactions recorded on the Platform;
2. Subscription reminders and requests for payment;
3. Promotional offers and services from the Company and its third-party partners, and
4. Any other matter concerning the Services.

Third-Party Services

The Services may include services, content, documents, and information owned by, licensed to, or otherwise made available by a third party (“Third Party Services”) or contain links to Third Party Services.

The Company makes no representations and hereby excludes all warranties and liabilities arising from or about such Third-Party Services, including their accuracy or completeness. Further, all intellectual property rights in and to Third Party Services are the property of the respective third parties.

The Company enables payments via payment service providers (“PSP”) partners, and the User should not intentionally or unintentionally share his personal UPI pin or OTP with any third party. The Company never solicits information such as UPI PIN or OTP over a call. The Company shall not be liable for any fraud due to the sharing of such details by the User. The providers providing Third Party Services / PSP partners shall not be liable for any fraud due to sharing of such information by the User.

User Responsibilities

The User hereby represents and warrants that all information that the User provides through or in relation to the Services is valid, complete, accurate, and correct on the date of agreeing to these Terms and shall continue to be valid, complete, accurate, and correct throughout the User’s use of the Platform.

The User shall not use the Services in any manner except as expressly permitted in these Terms. Without limiting the generality of the preceding sentence, the User may not:

1. Infringe either directly or indirectly any third-party proprietary rights, including but not limited to copyrights, patents, trademarks, or trade secrets, of any party;
2. Except as may be provided hereunder, use in any manner including copying, displaying, distributing, modifying, publishing, reproducing, storing, transmitting, posting, translating, creating any derivative works from, or licensing the Services;
3. Use the Services to transmit any data or send or upload any material that contains viruses, trojan horses, or any other harmful programs or similar computer code designed to affect the operation of any computer software or hardware;
4. Use any robot, spider, other automated device, or manual process to monitor or copy the Platform or Services or any portion thereof;
5. Systematically retrieve content from the Platform or Services to create or compile, directly or indirectly, a collection, compilation, database, or directory.

Intellectual Property

Unless otherwise stated, CornerSwitch Pvt Ltd and/or its licensors own the intellectual property rights for all material on AccoFarm. All intellectual property rights are reserved. You may access this from AccoFarm for personal use, subject to restrictions set in these terms and conditions.

The contents of this Platform, including, but not limited to, the text and images and their arrangements, are designed by the company and are copyright-protected in the whole and every part of this Platform, and the same belongs to the Company.

You must not:

1. Republish material from the Platform;
2. Sell, rent, or sub-license material from the Platform;
3. Reproduce, duplicate, or copy material from the Platform;
4. Redistribute content from the Platform;

Parts of this website offer an opportunity for users to post and exchange opinions and information in certain areas of the website. CornerSwitch Pvt Ltd does not filter, edit, publish, or review comments prior to their presence on the website. Comments do not reflect the views and opinions of the company, its agents, and/or affiliates. Comments reflect the views and opinions of the person who posts their views and opinions. The Platform charges a nominal subscription fee that is available as a package to operate, maintain, and support the Services.

The Company reserves the right to charge a convenience fee for the Services, and non-payment may result in denial of Services.

Refund/Cancellation

Modification

The Company reserves the right to add, modify, or discontinue, temporarily or permanently, the Services (or any part thereof) with or without cause. The Company shall not be liable for any such addition, modification, suspension, or discontinuation of the Services.

Disclaimers And Warranties

You acknowledge and agree that:

1. The Company is not engaged in the provision, grant, or disbursement of any financial product.
2. The Company is not engaged in improving the crop quality and yield.
3. The Company does not guarantee to increase your farm's income. Despite using the platform, the income solely depends on the farm owners and their practices in their farm and farm management process.  However, the platform helps you save time and resources, thus helping to grow your income.
4. The Company does not guarantee lesser expenses or more income. The Platform helps farm owners look clearly at the minute details of their income expenses to understand the spill-overs and unidentified expenses.
5. The Company does not provide farming machinery/fertilizers or anything related to the farm directly or in subsidized form.

You understand that the whole intention of the Platform is to help farm owners manage their farms effectively using digital support.  

To the extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis. The Company does not warrant that the operation of the Services will be uninterrupted or error-free or that the functions contained in the Services will meet your requirements.

You hereby accept full responsibility for any consequences arising from your use of the Services and expressly agree and acknowledge that the Company shall have no liability concerning the same.
